Her neighbor Cristian Montero, 35, was arrested in connection with her death and initially charged with witness intimidation, the Essex County District Attorney Paul F. Tucker said in a Sep. 4 press release.

On Tuesday, Sep. 10, the D.A.’s office confirmed to PEOPLE that Montero is now set to be arraigned on a murder charge.

Assistant District Attorney Jessica Fleet said in court that surveillance footage captures Flaz-Burgos entering Montero’s home that morning, making the “sign of the cross” before going in,Boston 25 News,CBS NewsandWHDHreport.

Meanwhile, Flaz-Burgos’ cellphone data showed the device was moving away from that location at the same time Montero was allegedly seen leaving the apartment, per Assistant District Attorney Jessica Fleet said,NECN andThe Boston Globereported.

Montero allegedly told investigators that he was in Lawrence during the time of Flaz-Burgos' disappearance, but his cellphone records allegedly indicate he was in Haverhill, per prosecutors,NECN and Boston 25 News reported.
